These Terms of Service govern your use of websites and services provided by Talented LLC, including scouttalented.com and its subdomains. By accessing our websites or using our services, you agree to these Terms. A separate written agreement controls if it conflicts with these Terms.
Talented provides recruiting, vetting, placement, and related services. Information on our websites is general information and is not a guarantee of employment, placement, candidate availability, performance, or business results. Specific services, fees, and commitments may be governed by a separate written agreement.
You must be legally able to enter into these Terms and provide accurate, current information when using our services. You are responsible for keeping account credentials confidential and for activity under your account.
The Talented recruiting and client-services messaging program provides application, interview, scheduling, recruiting, and service-related communications. If you provide your contact information in connection with an application, booking, request, or client relationship, we may contact you about that interaction. This may include transactional text messages such as interview confirmations and scheduling updates.
We send marketing text messages only after you give express consent specifically to receive marketing texts from Talented. These messages may be sent using automated technology. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. These Terms alone do not constitute consent to receive marketing texts.

Talented's websites, branding, software, text, graphics, and other materials are protected by intellectual property laws. Except as expressly permitted, you may not reproduce, modify, distribute, sell, or create derivative works from those materials. You retain rights in materials you submit and grant Talented permission to process them as needed to provide the services and as described in our Privacy Policy.
Our services may link to or rely on third-party websites, platforms, payment processors, communication providers, and other services. Their terms and privacy practices apply to their services. Talented is not responsible for third-party services that it does not control.
To the fullest extent permitted by law, the websites and services are provided “as is” and “as available.” Talented disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or completely secure operation.
To the fullest extent permitted by law, Talented will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or opportunities arising from the websites or services. Our total liability for claims governed only by these Terms will not exceed the greater of $100 or the amount you paid Talented for the applicable service during the six months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so those limitations apply only to the extent permitted.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute relating to these Terms must be brought in a state or federal court located in Maryland, unless applicable law requires otherwise.
We may update these Terms from time to time. Material changes will be posted here with a new effective date. Continued use of our websites or services after an update means you accept the revised Terms. If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
